Careless driving tickets carry three (3) points and must be handled by a professional to minimize the impact they have on your license and your wallet. The careless driving statute is an example of a law that was written when laws were construed narrowly but it is now interpreted broadly by many police officers when they write tickets.
(a) General rule.–Any person who drives a vehicle in careless disregard for the safety of persons or property is guilty of careless driving, a summary offense.
(b) Unintentional death.–If the person who violates this section unintentionally causes the death of another person as a result of the violation, the person shall, upon conviction, be sentenced to pay a fine of $500.
(c) Serious bodily injury.–If the person who violates this section unintentionally causes the serious bodily injury of another person as a result of the violation, the person shall, upon conviction, be sentenced to pay a fine of $250.
(d) Definition.–As used in this section, “serious bodily injury” means any bodily injury which creates a substantial risk of death or which causes serious, permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ.
Notice how “careless disregard” is not defined in the statute. Over the years “careless disregard” has come to be defined by a number of individual precedents where an appellate court has found that drivers were not guilty of careless driving.
Our office has lately seen an increase in the rise of careless driving tickets that are issued in reference to automobile accidents. Despite the fact that many of our clients are not at fault for the accident, they have been arbitrarily issued these tickets. As such, we would strongly suggest that they allow us to defend them in these matters and potentially avoid the three points associated with a guilty conviction of the ticket as well as the potential increase in their insurance rates.
