In Pennsylvania, sexual assault is a 2nd degree felony and can carry a sentence of up to 10 years in prison.
Except as provided in section 3121 (relating to rape) or 3123 (relating to involuntary deviate sexual intercourse), a person commits a felony of the 2nd degree when that person engages in sexual intercourse or deviate sexual intercourse with a complainant without the complainant’s consent.
Sexual Assault is often the fall back charge the state will rely on when they cannot prove rape. While rape requires something more than a mere lack of consent, sexual assault does not.
